Personal and carer's leave

Academic and general staff

If a staff member is required to provide care or support for a member of their immediate family or household due to personal illness or injury, or an unexpected emergency, they are entitled to up to five days paid carer's leave, within a 12 month period.

Once the five days is exhausted, a staff member can access personal leave when there is a need for further carer's leave in that 12 month period.

Personal Leave under the UCA now encompasses sick leave, carer's leave and other specified circumstances (where approved) as below.

There is no limitation on how much Personal Leave can be used for a particular type of approved absence.

Employees may take personal leave for any of the following absences:
a)where the employee is unfit for work due to personal illness or injury;
b)to attend an appointment with a registered health practitioner;
c)to provide a member of the employee's immediate family or household with care or support due to personal illness or injury, or in relation to a personal emergency affecting such a person. Prior to accessing personal leave for carer's leave purposes an employee (other than a casual employee) can request and be granted up to five days additional leave with pay in a 12 month period (for part-time employees, a pro-rata basis will apply). The five days referred to in this sub-clause is not cumulative;
d)to attend medical, therapeutic or business appointments of a close relative or friend (who is not covered by the definition of immediate family or household member) who is dependent on the employee for this particular appointment;
e)where a supervisor is of the opinion that a problem is adversely affecting an employee's work performance, such as stress, alcohol or drug dependence, or compulsive gambling, personal leave may be granted to attend an approved rehabilitation program; or
f)where a supervisor is of the opinion that a problem is adversely affecting an employee's work performance, such as marriage/family matters, domestic violence, personal leave may be granted to attend to such matters.

The UCA requires provision of a medical certificate or statutory declaration regardless of the length of the employee's absence if the absence relates to any of (c) to (f) above.

TAFE teaching staff

TAFE teachers are entitled to a credit of 15 days personal leave on full pay.  After the first year of service personal leave will accrued at the rate of 1.25 days per month.  Such leave may be used for personal illness or injury or to provide care and support for a member of their family or household who is ill.
